1. Agreement to Terms
Welcome to Calverse. These Terms and Conditions ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you” or "User") and Calverse ("Company", “we”, “us”, or “our”), concerning your access to and use of the Calverse mobile and web application as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Service”).
By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by all of these Terms and Conditions. If you do not agree with all of these Terms, then you are expressly prohibited from using the Service and you must discontinue use immediately.
2. Important Medical Disclaimer
Calverse is not a medical service. The Service is designed for informational and educational purposes only to help users track their nutritional intake and fitness goals. The Service is not intended to be a substitute for professional medical advice, diagnosis, or treatment.
- Always seek the advice of a qualified physician, registered dietitian, or other qualified health provider with any questions you may have regarding a medical condition.
- Never disregard professional medical advice or delay in seeking it because of information or suggestions you have received through the Service.
- The nutritional data and AI-powered suggestions within the Service have not been verified by a medical professional and are intended for general guidance only. Calverse is not responsible for any decisions you make based on the information provided in the Service.
3. User Accounts and Responsibilities
To access most features of the Service, you must register for an account. When you register for an account, you agree to the following:
- You will provide accurate, current, and complete information during the registration process and keep your account information updated.
- You are solely responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
- You must be at least 13 years of age to use the Service.
4. Subscriptions and Payments
Calverse offers both a free version and a premium subscription-based service ("Premium"). The terms governing the Premium service are as follows:
- Single Plan: We offer a single, one-time payment plan that grants you Premium access for one full year (365 days) from the date of purchase. This is not a recurring subscription. You may choose to renew your plan manually after it expires.
- Email Verification Requirement: It is mandatory to purchase the Premium plan using the same email address that you used to register your Calverse account. Our system links your payment to your account via this email address.
- Revocation of Access: If you purchase the Premium plan with an email address that does not match your registered Calverse account, your Premium access will not be activated or may be revoked without notice. It is your sole responsibility to use the correct email address.
- Payment Processing: All payments are securely processed by our third-party payment processor, Cashfree Payments. We do not collect or store your payment card details. That information is provided directly to Cashfree Payments and is governed by their privacy policy.
- No Refunds Policy: Due to the nature of digital goods and the immediate access granted to all Premium features upon purchase, all sales are final. We do not offer refunds for any reason once access has been granted. We encourage you to use the free version of the app to determine if the Service is right for you before purchasing.
- Mistakes and Support: If you believe you have made a genuine mistake during the purchase process (e.g., a typo in your email address), please contact our support team immediately at contact@calverse.in. We will review such cases on an individual basis but cannot guarantee a resolution.
5. User Conduct and Restrictions
You agree not to use the Service to:
- Violate any national or international law.
- Provide any false, misleading, or inaccurate information.
- Harass, abuse, or harm another person.
- Reverse engineer, decompile, or otherwise attempt to discover the source code of the Service.
- Use any automated system to access the Service in a manner that sends more request messages to our servers than a human can reasonably produce in the same period by using a conventional web browser.
6. Intellectual Property Rights
The Service and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Calverse, its licensors, or other providers of such material and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. You are granted a limited license only for purposes of viewing the material contained on this Service.
7. Termination
We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.
If we terminate or suspend your account, you are prohibited from registering and creating a new account under your name, a fake or borrowed name, or the name of any third party, even if you may be acting on behalf of the third party.
8. Disclaimer of Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, regarding the operation of the Service or the information, content, or materials included therein. You expressly agree that your use of the Service is at your sole risk.
9. Limitation of Liability
In no event shall Calverse, nor any of its officers, directors, and employees, be liable to you for anything arising out of or in any way connected with your use of this Service, whether such liability is under contract, tort or otherwise, and Calverse, including its officers, directors, and employees shall not be liable for any indirect, consequential, or special liability arising out of or in any way related to your use of this Service.
10. Governing Law and Dispute Resolution
These Terms and your use of the Service shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in India to resolve any legal matter arising from these Terms or your use of the Service.
11. Changes to These Terms
We reserve the right, in our sole discretion, to make changes or modifications to these Terms and Conditions at any time and for any reason. We will alert you about any changes by updating the "Last Updated" date of these Terms. It is your responsibility to periodically review these Terms to stay informed of updates.
